It is the only UK journal dedicated to adoption and fostering issues, providing an international forum for academics and practitioners in social work, psychology, law, medicine, training, and caring. As the official journal of BAAF, the UK's leading adoption and fostering membership association, the journal supports BAAF's aims of promoting the highest standards of practice in adoption, fostering and childcare services to increase public understanding of the issues and to act as an independent voice for children, informing and influencing policy-makers, all those responsible for children and young people and public opinion at large.

'Credit zombie' alive again, with lessons to teach

Judy Rivers isn't dead after all. And, as anyone who's had a maddening run-in with the nation's credit system would agree, her "resurrection" is miraculous.

Some loyal Red Tape readers might recall an August 2010 story we published on Rivers titled, "Hey banks: This woman is alive." ?At the time, Rivers had fallen -- or was pushed -- into a credit system black hole. She was declared dead by someone, rendering her invisible to the nation's lenders and other entities that rely on Social Security numbers for verification. She couldn't open a bank account, write a check, use a credit card, get a loan or an apartment. In many cases, she couldn't even apply for a job.?

She was, by 21st century standards, dead. Or, in perhaps a more-apt description, she had become a credit zombie.

Rivers, who lives in Alabama outside Birmingham, became a mini-celebrity after we published her digital nightmare. ?This woman is alive? was one of our most popular stories, and publications the world over retold Rivers? tale. Even Reader's Digest covered the story.

Her odyssey began in late 2010, when a bank told her its systems said she was dead ? and had been for two years.


?This Social Security Number has been discontinued; the holder of this number was reported dead on August 3, 2008," read a notice she was shown by a bank official. A check of her consumer report obtained from Chex Systems, which the bank had used to obtain that information, confirmed the error. It read, ?number inactivated due to report of death.?? Chex Systems said it received the data directly from the Social Security Administration, but that agency told Rivers that she was alive and well, according to its data.? She had the same experience with every other creditor and credit bureau she talked to. And there she remained for years, stuck in a Catch-22 despite her herculean efforts to find and correct the error.

?

As a result of her experience, Rivers became an advocate of credit zombies everywhere. She met with members of Congress and her state Legislature. She received many offers of help, employment,?even a few date proposals. (Side note: No one seems to know what happens if a "living" credit user marries a zombie.) She wrote letters and filed protests with every entity she could think of.?But every time she tried to get a credit report, she got the same response: "Deactivated because of death."

Meanwhile, her life took darker and darker turns. The 50-something woman couldn't get a job because companies couldn't verify her work history or her credit. She couldn't receive unemployment benefits -- or any government benefits -- because she was, well, dead.? One local bank, where she?d deposited money for years, agreed to cash checks for her, but otherwise she lived a pure ?cash existence.? She accepted a friend's offer to let her live?in a small trailer by Smith Lake, about 90 minutes north of Birmingham, while she fought her battle.?

Along the way, she met a host of other credit zombies, who, like her, had been pushed off the grid by the erroneous declaration of the death of their Social Security numbers.? According to the Social Security Administration, about 1,000 people each month are accidentally declared dead and their SSNs listed in the agency?s Death Master File. By some estimates, that means there are nearly half a million credit zombies walking around the U.S. right now.

"I feel very blessed," Rivers said. "My problems are minimal compared to the horror stories I have listened to."

After Rivers' story was published, other zombies sought her out for advice. One woman, from nearby Winston City, Ala., was wheelchair-bound and had stopped receiving her disability checks seven months earlier. She was unable to purchase medicine, and her family had no idea what to do. So Rivers accompanied her to the nearest Social Security office, which discovered the woman had been placed on the Death Master File a year earlier. Rivers eventually helped get her benefits restored.?

"She had been going without for seven months," Rivers said.

Accidental death isn't just for the elderly, however. Rivers also heard from an 18-year-old who had saved thousands of dollars in a bank account for college, and discovered when he tried to withdraw the funds for tuition that it had been frozen because he had been declared dead.? The student had to miss a semester while fixing the problem.

(Out of privacy concerns, Rivers said she couldn't share the identity of the other victims.)

All the while, Rivers kept lobbying for changes that would help victims, speaking with all nine members of Alabama's congressional delegation at some point. She has started work on a book describing the nightmare. She's working on a potential class-action lawsuit against various entities that have denied her and others credit.??

"I don't mind being the poster child for this," she said. "When I speak to people, I am very direct. I just ask them what they are doing to fix this."

But in all that time -- nearly two years -- no one was able to resuscitate her credit, and her digital life. She's sure of this because, under a lawyer's instructions, she has religiously applied for credit at least twice a month since August 2010. She had to steel herself against constant rejection.

"I've been turned down about 40 times," she said.

But two weeks ago, the unthinkable happened.

"I was at a Belk store, and the clerk said, 'Do you want to fill out a credit card application?' I told her it wouldn't do any good. But she gave me a funny look, and said, ?Why don't you try anyway?? It would get me 15 percent off my purchase. So I filled it out. I figured it would be this month's test," Rivers said. "Three minutes later it came back approved and I was in shock.? The clerk looked at me with an expression that said, 'You just made all that up.' She was a little disappointed when I didn't use the card to make the purchase. "

Dizzy with excitement, but also worried about false hope, Rivers marched across the street to a T.J. Maxx and applied for a second card.? Within minutes, she was approved for that one, too.?

?GUESS WHAT? I AM FINALLY LIVING," Rivers wrote in an exuberant email to msnbc.com a few hours later.

Rivers still has no idea how she ended up dead, though it almost certainly has something to do with the Social Security Death Master File.? In part because of her prompting, criticism of the DMF has ramped up in the past two years, and change seems to be in the air. Last fall, Rep. Sam Johnson, R-Texas, introduced the Keeping IDs Safe Act, which would change the way death reporting works. And in February a subcommittee of the House Ways and Means Committee held hearings on death record reporting, at which the Social Security Administration's Office of Inspector General offered critical testimony. ?

One often overlooked element of the problem: Even after the Social Security administration fixes death reporting errors, victims' SSNs often are still available through third-party websites, leaving zombies open to second nightmare: identity theft. "In some cases, these individuals? (personal information) was still available for free viewing on the Internet?on ancestry sites like genealogy.com and familysearch.org?at the time of our report," the inspector general said.

Social Security receives about 2.5 million death reports each year from multiple sources, including funeral homes, government agencies and family members. The inspector general, which says typographical errors are responsible for ?the bulk of the credit zombie problem, says there?s a simple solution: ?forcing Social Security to only accept reports from accredited entities using an electronic system.

"In February 2009, we found that about 98 percent of erroneous death entries on the DMF were death reports from non-state sources," it said. But even electronic reports from states wouldn?t eliminate the problem. "Even if all states were to submit death reports via (electronic death registration), there could still be some erroneous death entries on the (Death Master File).?

With all that Rivers has been through, she's not willing to believe her "death" is over.? Still waiting for proof that she has a valid credit report ? it is in the mail, she hopes. But most important, she's still unemployed. Her biggest problem remains the job application process, which almost always includes a credit check. Even when her SSN is restored, her credit report will be mysteriously empty for several years, and she fears that will still hurt her chances of landing a job.

So while Congress wrestles with solutions, Rivers intends to keep applying pressure for change, and keep working to promote awareness of the problem.

"If you own a Social Security card, this can happen to you," she said.?

RED TAPE WRESTLING TIPS: What to do if you're a credit zombie
If it does happen to you, there's one absurd question you must answer: How do you prove you're alive? Proving you're dead is relatively easy -- a death certificate will do the trick.? But proving you're alive? That will probably require an in-person visit to the Social Security office with a valid ID, such as a driver's license.? Copies of recent utilities bills, paystubs or other credit-related activity could help make the case, too.?

Have the clerk request a correction to the Death Master File, and don't leave the office without some kind of written record about the fix.? You'll probably need to send copies of that record to your bank, other creditors and the nation's credit bureaus.

The Identity Theft Resource Center recommends an additional step: finding the underlying death certificate and filing to have it amended. The certificate should be available from the county clerk or recorders? office where it was initially filed, and should include the name of the informant who reported the death. Contact that informant, the agency says, and have that person sign a State Vital Record Amendment Affidavit Form. Bring that form to the Social Security officer, the Identity Theft Resource Center recommends.

(AP) ? France's new Socialist government moved Wednesday to lower the retirement age from 62 to 60 years old for certain workers, bucking a global trend in a gesture to unions that critics say is a costly mistake.

Governments from North America to Europe have been pushing retirement ages higher and higher in recent decades, as people live longer and spend more years on state-sponsored pension checks.

New French President Francois Hollande, who won election last month on a wave of voter anger at austerity measures, proved Wednesday that his leftist campaign rhetoric was not just bluster.

Raising France's legal retirement age was one of conservative former President Nicolas Sarkozy's key reforms, aimed at reducing heavy government debts as Europe sunk into a continent-wide financial crisis. The reform met huge, nationwide protests ? yet many economists said it didn't push the retirement age high enough.

The minimum retirement age went from 60 to 62, and the age to receive a full pension regardless of how many years you pay into the system went from 65 to 67.

On Wednesday, Hollande's government presented a draft decree at a Cabinet meeting that reverses the retirement age to 60 for those who enter the workforce at 18 or 19 years old and have contributed long enough to the pension system. The right to retire at 60 was seen as a pillar of France's social benefit system for decades.

The government said the decree, affecting about one in six retiring workers, will be finalized later this month and take effect in November.

The decree also slightly eases pension requirements for mothers, noting "the impact of motherhood on women's careers," and for people who suffer workplace accidents.

The hard-left CGT union hailed the move as a "striking decision that breaks with policies everywhere in Europe."

The government says the costs ? estimated at ?1.1 billion ($1.37 billion) next year ? will be financed by a small rise in payroll charges paid by employers and employees. The government did not release a global cost for the measure.

Social Affairs Minister Marisol Touraine said the decree is a "choice for justice." Critics in France's powerful unions said Sarkozy's reform had unfairly punished low-income, unskilled workers.

Sarkozy and his allies argued that French workers had it too good, while busy workers in places like China and India are propelling their economies ahead.

France's leading business lobby, MEDEF, criticized the Hollande government's decree as "worrying for the financial future of the pension systems and for the competitiveness of businesses." Conservative politicians denounced it as short-sighted.

The Socialist Cabinet is making the change by decree, amending an existing decree on workers who serve especially long careers, instead of via a law, which would need approval by the lower house of parliament, currently dominated by conservatives.

France is holding parliamentary elections starting Sunday, and Hollande needs to secure a leftist majority to accomplish much of what he pledged on the campaign trail.

His push to lower the retirement age goes against demography: People in France live longer than almost anyone else in the world, with a growing life expectancy of 85 years for women and 78 for men.

And it goes against the global tide.

The full retirement age in the United States is being gradually raised from 65 to 67. Germany recently raised the legal retirement age for most people to 65 for women and 67 for men.

In Italy, a few years ago some workers could retire as young as 50, but new austerity measures under Premier Mario Monti put an end to that. The retirement age was raised from 65 to 66 for men, starting this year. For women, it was raised from 60 to 66, starting in 2018.

Three decades ago, France's retirement age, at 65, was among the highest in Europe. In 1982, late Socialist President Francois Mitterrand lowered it to 60.

Wisconsin recall battle finally goes to voters

MADISON, Wis. (AP) ? The battle over Gov. Scott Walker's agenda has attracted millions of dollars from out of state, campaign volunteers from across the country and months of concentrated attention from the two major political parties.

But on Tuesday, the only voices that matter will be those of Wisconsin voters deciding whether to keep Walker or fire him and hand his job to the Milwaukee mayor. After more than a year in the national spotlight, both sides are preparing for a razor-thin margin.

Polls show Walker, a Republican just 17 months into his term, with a small lead over Democrat Tom Barrett.

"You know what distresses me?" state Sen. Mark Miller said to a group of Democratic volunteers last week in Madison. "It's close. It's so darn close."

During Monday's first campaign stop, Walker said he expects a close race, too, and he's focused on turning out voters who supported his efforts to take on public-employee unions.

"We want to move on and move forward," Walker said at a plastics plant near Madison. He was joined by his wife, Tonette, who wore a button that read "Luv My Gov."

Walker planned other campaign stops at a brewery in Stevens Point and a distillery in Green Bay before wrapping up with a nighttime rally in Milwaukee.

Barrett was spending most of Monday in western and northern Wisconsin before ending his day with a rally at a United Auto Workers union hall in Kenosha.

Walker is only the third governor in U.S. history to face a recall vote. The other two lost, most recently California Gov. Gray Davis in 2003. Wisconsin's recall election is a rematch of the 2010 governor's race in which Walker defeated Barrett by 5 percentage points.

Walker's lieutenant governor, Rebecca Kleefisch, and three Republican state senators also face recall votes Tuesday. In addition, voters will fill a fourth state Senate seat after the Republican incumbent resigned rather than face the recall.

Anger over Walker and his conservative agenda began building almost as soon as he took office in January 2011. Just a month into his term, Walker took the state by surprise with a proposal to effectively end collective bargaining rights for most state workers. The recall idea emerged soon thereafter.

But the recall petition drive couldn't officially start until November, months after Walker signed the union changes into law. Organizers hit the streets a week before Thanksgiving and spent two months gathering more than 900,000 signatures ? about 360,000 more than were needed to trigger the election.

Retired teacher Jan Stebbins cast her ballot early for Barrett, just as she did two years ago. She said she's been offended by Walker, not by what he's done but "how he's done it."

Stebbins can't stand the division that's emerged in the past two years.

By Wednesday morning, she hopes the state "gets back to a little bit more unity," she said. "I don't know what will happen."

Todd Schober, a financial planner from Racine, voted for Walker in 2010 and plans to do so again on Tuesday.

"When is this going to end?" he asked after shaking his head and sighing. "I'm just going to be so glad when it's all over."

Walker, the 44-year-old son of a minister, has remained unflappable throughout the campaign just as he was during the massive protests that raged at the Statehouse for weeks as lawmakers debated his proposal.

Along the way, he's become a star among Republicans and the most successful fundraiser in Wisconsin politics, collecting at least $31 million from around the country since taking office. That obliterated his fundraising record of $11 million from 2010.

About $63 million has been spent on the race so far, including $16 million from conservative groups such as the Republican Governors Association, Americans for Prosperity and the National Rifle Association.

Democratic groups ? including those funded by unions, the Democratic Governors Association and the Democratic National Committee ? have poured in about $14 million, based on a tally from the government watchdog group the Wisconsin Democracy Campaign.

The majority of Walker's donations have come from people outside Wisconsin. Most of Barrett's $4.2 million came from inside the state.

The race has implications for national labor unions. It's also seen as a proxy fight for the presidential election, especially given the importance of Wisconsin and its 10 electoral votes.

President Barack Obama has kept his distance, just as he did during the unrest last year. Other prominent Democrats, including former President Bill Clinton, campaigned for Barrett in the week leading up to the vote.

White House press secretary Jeff Carney was asked during a briefing Monday why Obama wasn't campaigning for Barrett.

"The president supports him, stands by him," Carney said, adding that Obama hopes Barrett prevails.

Walker enlisted the support of several prominent national Republicans, including New Jersey Gov. Chris Christie and South Carolina Gov. Nikki Haley, an unabashed union hater.

A Marquette University Law School poll released last week showed Walker with a narrow 7-percentage point lead over Barrett, 52 percent to 45 percent. The poll's margin of error was 4.1 percentage points. In the same poll two weeks earlier, Walker held a 6-point lead, 50 percent to 44 percent.

The poll also showed the deep division in Wisconsin, where 39 percent of respondents said they liked the job Walker has done and 38 percent said they did not like it. Twenty-one percent said they like what he's done, just not how he did it.

In the days leading up to the election, they expressed a mixture of anticipation and fatigue with the political turmoil.

In the working-class city of Janesville, signs on both sides of the election were scattered across the community, some just a few feet apart.

Retired businessman Dave Flury plans to support Walker. And he's worried about what will happen if Barrett wins.

"If Walker loses, shouldn't Republicans turn right around and recall Barrett?" Flury asked.

For months, voters have been inundated with telephone calls, campaign mail and television advertising. Barrett supporter John Oehrke is ready for all of it to end.

"It doesn't really matter who wins I guess," Oehrke said. "It's all crazy.

Big Ten prefers plus-1 to 4-team playoff

(AP) ? Big Ten administrators would prefer a plus-one system over a four-team playoff to determine a national champion if the BCS can't be maintained in its current form.

Nebraska chancellor Harvey Perlman said conference presidents would choose to keep the current BCS system as is if there were a vote today. But he added change appears to be inevitable. In the plus-one format, the bowl games would be played, and then the top two teams would meet for the title.

"We think that in many respects, (the current system is) as good as you could do, with obviously some changes about automatic qualifying and perhaps how the top two teams are selected," he said. "But we're also realistic. That doesn't seem to be one that has gotten a lot of support, and that some movement is necessary."

Perlman spoke on a conference call with reporters Monday, a day after presidents and chancellors met at league headquarters in suburban Chicago. As the top conferences negotiate over a playoff system, the Big Ten is showing some flexibility, while remaining adamant that the bowls and its alliance with the Rose Bowl be preserved.

While it prefers the plus-one model, the conference seems willing to listen to proposals for a playoff system. Either way, commissioner Jim Delany acknowledged, the current poll-based system is flawed. A selection committee might be an option in picking the postseason teams, Delany said.

Three meetings this month could go a long way toward molding the playoff model, although Delany said discussions could stretch beyond that ? the BCS meeting June 13 in Chicago; the NCAA Division I Conference Commissioners Association on June 19-20 in Chicago; and the BCS Presidential Oversight Committee June 26 in Washington.

"The key issues are honoring champions, honoring strength of schedule, honoring teams and coaches that try to play good schedules and recognizing a team that plays an additional championship game versus one that doesn't has an additional obstacle of challenge," Delany said.

He has floated the idea in the past that top three conference champions and an at-large team make up the playoff field "as a way to think about who's in the event" but isn't married to that concept.

"We do feel strongly that champions ought to be honored," Perlman said. "There was little disagreement that the polls and certainly the computer polls are not sufficiently transparent. People don't respect them as much as they could. They can't take into account a variety of circumstances. I think we would feel comfortable with a selection committee, but even if you move to a selection committee, I think there are issues about what instructions they're under with regard to how they determine who the best four teams are. We didn't resolve that at this point."

The Big 12 and SEC say the top four teams ? not necessarily conference champions ? should be in a playoff field.

"I would agree. I think it should be the four best teams," Delany said. "I think the question is whether or not a computerized poll managed the way the one is today is an appropriate proxy for the four best teams. I totally agree we should have the four best teams."

He also believes winning a conference championship "should matter."

"That's the way we've been structured for 100 years," he said.

Delany reiterated the Big Ten would like to include the bowls in any postseason format, with the championship game being bid out either to a current site or cities that aren't necessarily bowl hosts. He also said the plus-one scenario remains on the table, and he mentioned the Rose Bowl when he was asked why the conference prefers that option.

"The Rose Bowl, I think, is one of the outstanding sports events, sports properties, sports brands in the world," he said. "I don't think that's an overstatement."

Delany also said there would still be "reasonable access" to championship opportunities for the Big Ten in a plus-one format even if the odds would seem to be better with a playoff.

"When you're working with groups of people, sometimes, you can't have your cake and eat it, too," Delany said. "That's what compromise is about. And you try to avoid demands. I would say one of the reasons we have a chance to come together is not everybody is trying to get their cake and eat it, too."

NOTES: Delany said he's no fan of mega conferences. Asked if he envisions a day where teams from four super conferences compete for a shot at the national championship, Delany he said, "I don't see that." He added: "I think what you'll see is some conferences grow. Some stay where they are. ... We had one 16-team conference ? it was the WAC. It didn't stand very long. We had another conference that went to 12 members and then had to add two to get back to 10. We've seen the Big East morph in a variety of ways. I think one of the most underrated qualities about any conference is its stability and the glue that holds it together." He said conferences that expand too much run into "possible dilution issues." ... Delany said it's not clear how much extra money would be generated by a playoff and probably won't be until after system is hashed out. "We have TV consultants, but they really cannot test the marketplace until they know what they're selling," he said. "And they won't know what they're selling until we reach closure on the model ? the who and the how. ... I think there's a general consensus in the industry that it's a good marketplace for college football."

As the commercial real estate market slowly recovers throughout Chicago and its suburbs, a pair of top brokers with the RE/MAX Northern Illinois real estate network pointed to one class of commercial buildings that are drawing increased attention throughout the region: medical office buildings, urgent care centers, hospital expansions and other forms of healthcare real estate.

Dave Shalabi, a broker with RE/MAX Synergy in Orland Park, and Deepika Syal, a broker with RE/MAX United in Wheeling, both say that they are seeing a growing number of doctors, physical therapists, dentists and other medical professionals looking for new space in Chicago and its suburbs.

This increase in demand for new space by the healthcare community is providing a solid boost to commercial real estate in general in the Chicago area, the RE/MAX brokers said.

As an example, Shalabi points to an MRI clinic that he recently helped lease vacant space in the southwest suburbs of Chicago. His hope is that this is just the first move in a string of new medical providers locating in the area.

?We are very excited to see just how strong demand for medical office space is becoming,? Shalabi said. ?We think this deal will help spur other medical providers to fill up some of the vacancies in the area.?

Syal, too, says that she is seeing an increase in the number of medical providers in the Wheeling area buying buildings and leasing vacant office space.

Part of the increased demand comes down to economics: Rents have fallen in all commercial real estate categories, including medical office space. This has made it more affordable for physicians and other medical providers to move into nicer office space.

?The doctors and other medical professionals are making moves,? Syal said. ?They are moving to bigger and larger spaces because prices have fallen. They are able to upgrade to better spaces without having to spend as much money as they would have just three or four years ago. Many medical providers are actually buying buildings today, too. They have that ability today, with the more affordable prices, to go out and grab a nice a space for themselves.?

National numbers validate the optimism felt by Syal and Shalabi. According to data from real estate information firm CoStar, the total vacancy rate for medical office space fell to 11.3 percent during the first quarter of 2012. That?s the lowest this rate has been since late 2008, according to CoStar.

The strength of the healthcare real estate market has even inspired some developers to build new medical office buildings, urgent care centers and hospital additions. This is relatively rare today in commercial real estate, as new construction for most commercial sectors has slowed to a halt. According to CoStar, though, developers added nearly 3.5 million square feet of office space across the United States in the first quarter of the year. That is the most new space in this sector since early 2009.

The strength of this market, though, shouldn?t be a surprise. People, after all, need to see doctors, dentists, psychiatrists and physical therapists whether the economy is strong or weak. In addition, demand for healthcare services in the United States seems likely to grow as the country?s population continues aging.

This is part of the reason that the U.S., according to a recent report by the Council on Foreign Relations, spends an estimated trillion every year on healthcare expenses, the highest figure for any industrialized country.

According to Shalabi, strong demand for medial office space helps build a healthy commercial real estate market because most doctors and other medical providers typically take out longer-term leases than do other commercial tenants. That, in turn, adds to the stability of commercial districts, Shalabi said.

?These longer-term leases are something we haven?t seen much of in the past few years,? he said. ?When medical providers take leases of this type, they help sustain the strip malls and office corridors into which they move. Plus, they help generate increased foot traffic that attracts other businesses to fill nearby vacancies. Retail and other professional businesses like to be near medical providers. A strong demand for medical space helps boost the economy as a whole.?

Shalabi is optimistic, too, that a proliferation of urgent care facilities will help reduce commercial vacancies across the Chicago area.

?We are seeing urgent care facilities pop up all over,? Shalabi said. ?People are demanding them. They want to be as close as possible to medical providers, and these urgent care facilities provide this opportunity. I have young children, and I find it comforting myself to see these facilities going up.?

Syal, too, has seen the increased demand for medical office space. In fact, her RE/MAX office recently moved to a new location in Wheeling. What filled the space they left behind? An eye doctor.

In her market, Syal is seeing building owners increasingly splitting larger spaces into smaller office suites. This, too, has helped attract medical providers to the area, she said, as doctors and others seek out smaller, more affordable office space in which to locate their practices.

?It?s hard to find tenants today for very large spaces,? Syal said. ?At the same time, however, building owners are dividing these big spaces. For lower rents, medical providers can find some very appealing office space for their practices. And because they can get the space they need at an attractive rent, many are taking out longer leases.?
